These terms govern your access to and use of the PaisaGraph website, mobile applications, and advisory services. Please read them carefully before using our platform.
1. Introduction
These Terms of Service ("Terms") constitute a legally binding agreement between you and PaisaGraph Management ("PaisaGraph", "we", "us", "our") governing your access to and use of paisagraph.com, our mobile applications, and any advisory services we provide (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Services. These Terms should be read together with our Privacy Policy, Risk Disclosure, and Regulatory Disclosures.
2. Eligibility
Our Services are intended for individuals who are at least 18 years of age, are residents of India (unless otherwise agreed in writing), and are legally capable of entering into a binding contract under the Indian Contract Act, 1872. By using our Services, you represent and warrant that you meet these eligibility requirements.
3. Account Registration
To access certain features, you will need to register for an account and complete our Know Your Customer (KYC) process. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify us immediately at support@paisagraph.com if you become aware of any unauthorised use of your account.
4. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. Our platform provides:
- Mutual fund advisory and marketplace tools — fund discovery, comparison, and recommendations.
- Calculators and planning tools — including tax harvesting and risk-radar utilities.
- Educational content — market commentary, tax guides, and general investor education.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with reasonable notice where practicable.
5. Nature of Advisory Services
PaisaGraph is registered with SEBI as an Investment Adviser. Any advice provided through the Services is advisory in nature and based on the information you provide during risk profiling. We do not guarantee returns, capital protection, or the performance of any recommended investment. Investment decisions remain solely yours, and you are advised to read all scheme-related documents before investing.
PaisaGraph does not accept custody of client funds or securities. All transactions are executed directly between you and the relevant AMC, RTA, or exchange-registered intermediary.
6. Fees & Payments
Where applicable, advisory fees are charged in accordance with the fee structure disclosed in your advisory agreement and our Regulatory Disclosures. Fees, once agreed, will not be revised without prior written intimation. Any applicable taxes are charged in addition to the advisory fee.
7. Intellectual Property
All content on the Services — including text, graphics, logos, tools, calculators, and software — is the property of PaisaGraph or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Services without our prior written consent, except for your own personal, non-commercial use.
8. User Conduct
You agree not to:
- Use the Services for any fraudulent, unlawful, or unauthorised purpose.
- Attempt to gain unauthorised access to our systems, other users' accounts, or non-public areas of the Services.
- Interfere with or disrupt the integrity or performance of the Services, including through malware, scraping, or automated data collection.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use any content from the Services to build a competing product or service.
9. Third-Party Services & Links
The Services may link to or integrate with third-party websites, AMC platforms, or data providers. We do not control and are not responsible for the content, accuracy, or practices of these third parties. Any hyperlink to a third-party site is followed at your own risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, PaisaGraph, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits, revenue, or data, arising out of or in connection with your use of the Services, including any investment decisions made using information provided through the Services.
Nothing in these Terms limits any liability that cannot be excluded under applicable Indian law, including obligations under SEBI regulations.
11. Indemnification
You agree to indemnify and hold harmless PaisaGraph and its directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses arising out of your breach of these Terms, your misuse of the Services, or your violation of any applicable law.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or where required by a regulator or law enforcement authority. You may close your account at any time by writing to support@paisagraph.com, subject to completion of any pending regulatory obligations.
13. Grievance Redressal
If you have a grievance regarding the Services, please contact our support desk at support@paisagraph.com. Unresolved matters may be escalated to our Compliance Officer, who will respond within 24 hours. If your complaint remains unresolved after 30 days, you may raise it with SEBI through SCORES at scores.gov.in, or the applicable Online Dispute Resolution (ODR) portal.
14. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to the SEBI-prescribed dispute resolution mechanisms referenced above, any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at Gautam Buddha Nagar, Uttar Pradesh.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, business practices, or applicable regulation. Material changes will be notified via email or a prominent notice on our website. The "Last updated" date at the top of this page indicates when these Terms were last revised. Continued use of the Services after such changes constitutes acceptance of the revised Terms.
